Welcome to AltCards ("the Service"), operated by AltCard Limited, a company registered in New Zealand. These Terms of Use ("Terms") govern your access to and use of the Service, including our website, applications, and any related services.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old. If you are under 16, you may not create an account or use the Service.

You retain ownership of any Content you upload to the Service. By uploading Content, you grant AltCards Limited a non-exclusive, worldwide, royalty-free licence to use, process, store, and display your Content solely for the purpose of operating and providing the Service.
When uploading photos that include other people, you represent and warrant that you have obtained appropriate consent from those individuals for the use of their likeness in connection with the Service. You also represent that you have the right to use any photos you upload (e.g. you took the photo, or have permission from the photographer or rights holder).
You are solely responsible for the Content you upload and any consequences of sharing it through the Service.
The Service uses artificial intelligence to generate card designs and images. You acknowledge that:
The Service, including its source code, design, user interface, branding, logos, and name, is the intellectual property of AltCard Limited and is protected by copyright and other intellectual property laws.

Your use of the Service is also subject to the terms and conditions of these third-party providers. We are not responsible or liable for the actions, policies, or practices of any third-party service.
The Service offers one free card per account. Additional cards and features are available through paid plans processed via Stripe.
If you encounter content that violates these Terms or is otherwise harmful or inappropriate, you can report it by:
We reserve the right to review, remove, or disable access to any Content that we determine, in our sole discretion, violates these Terms. We may also suspend or terminate the accounts of users who engage in misuse.
You must not use the Service to impersonate any person, entity, or organisation, or to falsely suggest an affiliation or endorsement that does not exist. You must not use third-party trademarks, logos, or brand names in your Content without proper authorisation from the rights holder.
AltCard Limited is not responsible for user-generated content that may infringe upon the intellectual property rights of others. You agree to indemnify and hold us harmless from any claims arising out of your Content that infringes upon the rights of any third party.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, AltCard Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including under the New Zealand Consumer Guarantees Act 1993.
You agree to indemnify, defend, and hold harmless AltCard Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to other users, the Service, or AltCard Limited.
You may delete your account at any time through the Service. Upon termination or deletion, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply.
These Terms shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
